1. General Terms
- Nature of Services: Raag Consultants provides legal advisory and consultancy services, including but not limited to business and corporate law, dispute resolution, compliance, intellectual property rights, and more. The services provided are often tailored to the specific needs of our clients, and therefore, most of our services are non-refundable.
- Consultation Fees: Fees for legal consultations are paid by the client before the consultation or service is provided. The fees are typically charged on an hourly or project basis, depending on the nature of the service.
2. Refund Eligibility Criteria
- Service Not Rendered: If Raag Consultants fails to provide the legal services as agreed upon in the engagement letter or contract, the client may be eligible for a full refund of any advance paid, subject to evaluation and approval by the management.
- Request for Refund: If a refund request is made, the following conditions must be met for eligibility:
- The request must be made within 7 days of the service being paid for, or within a reasonable timeframe considering the nature of the service.
- The client must provide a valid reason for the refund request, which will be evaluated by Raag Consultants.
- Partial Refunds: In case of partial services being rendered or if work on the project has already begun, Raag Consultants may issue a partial refund based on the work completed at the time of the refund request. This will be calculated in proportion to the work already performed and the costs incurred.
- Non-Refundable Fees: Certain charges, such as application fees, filing fees, or third-party service charges, are non-refundable. These are costs that Raag Consultants may incur on behalf of the client and are paid to external parties, making them non-refundable in nature.
3. Situations Not Eligible for Refunds
- Change of Mind: If the client changes their mind about proceeding with the service after the engagement has begun or after payment has been made, no refund will be issued unless the situation is covered under exceptional circumstances outlined in this policy.
- Non-Compliance by Client: If the client fails to provide necessary documents or information required for the consultancy process, or if the client acts in a manner that disrupts or delays the consultancy work, Raag Consultants reserves the right to refuse a refund.
- Completed or Delivered Services: Once the legal consultation or service has been fully delivered, or once significant progress has been made on a matter, Raag Consultants will not issue refunds. This includes advisory services, reports, documentation, or any representation provided in the course of the consultancy.
- Contractual Agreements: If a specific contract or engagement letter with the client contains provisions regarding refunds, those provisions will take precedence. Any additional terms that may be agreed upon at the time of signing will apply.
4. Refund Process
- Request Submission: To request a refund, the client must send a formal written request to Raag Consultants, detailing the reason for the refund, the service or consultation in question, and any other relevant details. - Evaluation: Once the refund request is received, Raag Consultants will evaluate the request in accordance with the conditions of this Refund Policy. The evaluation may take up to 7 business days to complete.
- Refund Decision: After reviewing the request, Raag Consultants will notify the client in writing of the decision. If approved, the refund will be processed within 14 business days from the date of approval, using the same payment method used by the client.
- Refund Amount: If a refund is granted, it will be processed for the amount paid minus any applicable non-refundable fees, service charges, or costs incurred by Raag Consultants in rendering the services.
5. Refunds on Subscription Services
For any subscription-based services provided by Raag Consultants, the following additional conditions apply:
- Subscription Cancellation: Clients may cancel a subscription to legal services at any time. However, refunds for unused portions of a subscription will only be issued if the subscription is canceled before the service has been utilized. Refunds for partial months or services already rendered will not be given.
- Automatic Renewal: In the case of automatically renewing subscription services, the client must notify Raag Consultants in writing at least 5 days prior to the renewal date to cancel and request a refund for the new subscription period.
6. Force Majeure and Unforeseen Circumstances
Raag Consultants will not be held responsible for delays or failures in service provision due to events beyond its control, including natural disasters, strikes, or governmental restrictions. In such cases, no refund will be issued unless the failure to deliver services is deemed to be within the control of Raag Consultants.
7. Governing Law and Dispute Resolution
- Jurisdiction: This Refund Policy will be governed by the laws of India, and any disputes will be subject to the jurisdiction of the courts located in Delhi, India.
- Dispute Resolution: If there is a dispute regarding a refund request, the client and Raag Consultants agree to resolve the issue through mediation or arbitration before resorting to legal action. The decision made by the arbitrator or mediator will be binding.
8. Modifications to the Refund Policy
Raag Consultants reserves the right to modify or update this Refund Policy at any time. Any changes will be communicated to clients via email or posted on our website. The revised policy will be effective immediately upon posting.
